NEWS UPDATES

PRODUCTIVITY COUNCIL  MEETING HELD ON 18Th December 2013 AT OFB.
Progress position of Issues

1.        Publication of Seniority List of CM & Promotion from CM to JWM of the year 2013-14:

         It is informed by the task force committee that 50% of the factories send their data to task force committee however approx 50% of the factories were repeatedly ask to forward the data within week, further the Chairman also asked to Member/Per to make a telephonic dialog with those factories who had not send the data till date accordingly the Member/Per also make telephonic discussions with the factories who has not send the data. In continuation of the above a letter which was written by Chairman of task force committee to the Secretary-OFB is enclosed herewith for the requirements of the committee for finalization of seniority of CM(T&NT).

         In view of the above it is once again requested all branches (under OFB) to sent their data as per the guide lines given in the above letter written by Chairman of task force committee to the Secretary-OFB. This is also for those factories who have send their data already to the task force committee, for insuring the complete compliance/requirement of task force committee.                                                                                                           


2.      Cadre Review of  Chargeman and JWMs :

        OFB has already send  the proposal to create a post of JWM(SG) in the G.P. Rs 5400 (PB-2).

         In continuation of the above the OFB send an another new proposal for JWM to the MoD for approval as under

1.  To create a post of JWM(SG-2) in the G.P. Rs 5400 (PB-2) for 2730 post (approx)
2.  To Create a post of JWM(SG-1) in the G.P. Rs 5400 (PB-3) for 1000 post (approx)

      Apart from the above it is further intimated that 165 (approx) post of JWM has to be surrendered in acceptance of above proposal.


3.       SRO of CM-T/NT & JWM-T/NT :

          SRO of Chargeman-T&NT is under discussion and awaiting for amicable settlement, however the SRO for JWM-T/NT, has already send.

4.          Promotion from JWM to AWM

183 resultant post of AWM to be filled by JWM promotion has been forwarded for DPC to the ministry has come back to OFB with some observations, to be clearified.

5.         Proposal for 7th CPC

    A complete Questionnaire prepared for Branches for submitting their views/proposals to CE , on various core issues to be represented to the 7th Pay Commission for circulation the same amongst their members to discuss in their GB meeting, and give feedback to the CEHQ accordingly within reasonable time latest by 1st week of January -2014 . The Branches may also send the proposal in a combined way from respective Zones The CE shall receive the proposals from the branches/Zones only. The Questionnaire is enclosed herewith as ANNEXURE.

    Kindly refer the Questionnaire already send to the branches & send their proposal and observations seriously well within the time.

All the members are requested to go through the points mentioned above and do appropriate action in the interest and better future of our cadre.

The Incoming 7 th Pay Commission   

Dear Friends,

     As all of you are aware of that the Govt of India has announced its approval for constitution of the VII th  Pay Commission  for the central Govt  employees. Its formal constitution with terms & reference is awaited.

An Overview on the Earlier Pay Commissions   :

All the six pay commissions have taken many aspects into consideration to prescribe the pay structure for government servants.
    In the First Pay Commission  the concept of ‘living wage’ was adopted. (Implemented in  1946 )

    In Second Pay Commission it had been reiterated that the pay structure and working condition to be crafted in a way so as to ensure the effective functioning of government mechanism. (Implemented in  1957)

    The Third Pay Commission adopted the concept of ‘Need Based wage’ (Implemented in  1973 )

     The Fourth CPC had recommended the government to constitute Permanent Machinery to undertake periodical review of pay and allowances of Central Government employees, but which got never implemented.(Implemented in  1986 )

     In Fifth Pay Commission all federations demanded that the pay scale should be at par with the public sector. But the pay commission didn’t accept this and told that the demand for parity with the Public Sector was however difficult to concede as it felt that the Job content and condition of service in the government and public sector not necessarily the same. There were essential differences between the two sectors. The Fifth CPC had Compressed many Scales. The number of pay scales was reduced from 51 pay scales as on 31.12.1995 to 34 pay scales by the Fifth CPC. (Implemented in1996
  
      The Sixth Pay Commission mainly focused on removing ambiguity in respect of various pay scales and mainly focused on reducing number of pay scales .It recommended for removal of Group-D cadre. The total number of grades reduced to 20 spread across four distinct running pay bands; one Apex Scale and another grade for the post of Cabinet Secretary/equivalent as against 35 standard pay scales existing earlier. The new concept of Pay Band & Grade Pay was introduced.(Implemented in  2006)

 The 7th Pay commission has been announced by the Govt. We have to make all out efforts to represent to the pay Commission to get best possible recommendations for our cadre in particular and common benefits admissible to all employees in general. This depends largely on how best we are in a position to convince the Pay Commission about our expectations ,when we get the opportunity to incorporate our legitimate requirements in a memorandum to be submitted to Pay Commission and further justfy the same during the oral meeting with them.

Please find herewith a questionnaire for our branches so as to get the feedback/views from the members of this association, which shall be sent to the CE after threadbare discussion in the respective GB meetings of the branch associations.

     The sprit behind this is to involve the grass root level of this association in the process of formulating our views/proposals  which are to be sent to the Pay Commission. I have tried to make out a brief on the specific issues  inviting proposals/views. Your cooperation / involvement, shall help us to make out a memorandum with  full logic and justifications.

(1) PAY SCALES:     Determination of

To arrive at the new pay-scale take into account

 (Our proposal for revision of pay-Scales shall be wef  01-01-2016 , the date from which   we shall demand for implementation of VII th CPC recommendations )
·         Existing Pay Scale  . for C/M  is 9300-34800   Grade Pay 4200)
·          Dearness Allowance @ 99 to 100% is expected as on 1-1-2014. With the present trend of rise in the Consumer Price Index ,the DA  is expected to be  @ 130 to 135 % (approx)  as on 1-1-2016 .Hence we may formulate the Revised Pay scales based on the following factors.
    
    Pay in the Pay Band + Grade Pay + 130% DA(estimated as on 1-1-16)

The Fitment Benefit then be added to it. . In line with 6 CPC the fitment Benefit can be reflected through Increased Grade Pay.

·         Interim relief to be granted if any (presently Nil) to be added
·         If any DA is merged with Pay (presently Nil) to be effectively added
·         Estimated Increase in the pay-scale  (How many times of present one) to be mentioned

 (B)  Pay-scales   of our cadre

 Since the Supervisory cadre ( both Tech & Non Tech ) runs from Chargeman  to JWM, and all the Pay Commissions have always been giving recommendations for the entire supervisory cadre(including that of JWM), under the head workshop staff .Hence the proposal shall include JWM cadre also although the post is Gr ,B  Gazetted and out of the fold of our association. It is further suggested that since the Revised MACP provides Three Up gradations, the Proposed Pay scale for AWM & WM posts be also suggested. Further while formulating the pay scale of JWM, it should be kept in mind that there is a continuous degradation /erosion in the pay scale of JWM since last three ( 4th to 6th) Pay Commissions.

 (2)   Fixation benefit    As per the practice followed, while effecting the new pay-scales the total emoluments ( BP + DP(if any) +DA +IR as applicable )  , as on the date of effect of the revised pay-scale, is added with the fixation benefit (the fixed %) .At the time of Vth CPC the fixation benefit was given @ 40% of the Basic Pay  In VI th CPC the new system of Grade Pay was evolved which was equal to 40% of the existing end Pay scale. At present there is no element of DP(Dearness Pay ie DA merged with Basic Pay) or IR (Interim relief).The existing emolument consists only Pay in the Pay Band and the Grade Pay.

(4)  Inter-grade Ratio   of our cadre

This is a very important issue. Before the Vth CPC the Inter Grade Ratio of our cadre was very poor which had resulted in large scale stagnation in all the grades. It is only after our strong representation to the Vth CPC, comparing ourselves with Railways with full justifications , we achieved the upward revision(Existing up to 31-12-2005) in our ratio (almost at par with Railways) which resulted large scale promotions after Vth CPC and the residency period in each grade was reduced considerably .Our effort has always been parity with Railways.

(B)  Non _Technical Sup Cadre (In Ord Fys)     
(This cadre exists only in Ord Fys)

The post of JWM NT was created as per the recommendation of Vth CPC on the basis of our strong representation  in this regard , to maintain parity in the pay-scales of Tech/Non Tech Supervisory cadre . However the Vth CPC had recommended only 5 % post in this cadre. Subsequently there was a demand from all concerned to increase the % of posts in JWM NT cadre (at par with Technical), which was raised with VI th CPC also, Hence the proposal to this effect may be formulated .We had represented to VI th CPC to maintain the same ratio for Technical as well as Non-Tech cadre.We should continue to maintain the same stand.

·         Justifications for the proposal for Uniform Ratio for Technical & Non Technical Cadre

The following justification was raised with the 6 CPC for grant of similar Inter-grade Ratio to Technical & Non-Technical cadre for maintaining full  parity. 
The Supervisory cadre in the Ministry of Defence Production, is exclusively for the middle management cadre. In Ordnance Factories they constitute the executive cadre in the Engineering , Material Management, Marketing, Export, Administration, Project Management and Management Information system. They are the  Engineers/Scientists/Chemists/Metallurgist/Instrument, Textile, Leather, Optical, Computer Technologists and executives of Material Management/ Project Management / Personal management & Administration and thus form the backbone of the organization
The Supervisory cadre is categorized into different trades e.g. Mechanical, Civil, Electrical, Chemical, Metallurgical, Leather ,Non-Technical (stores and other than stores) etc. In fact the term used “Non-Technical” is misnomer. The difference between Technical and Non-Technical NGOs is only empirical, the grades in both streams bear same responsibilities and are identical in functioning methods, and hence the earlier Pay Commissions have prescribed the equal pay-scale to Non Technical cadre at par with Technical one on the basis of their job evaluation. This justifies the grant of uniform inter grade ratio for both Technical & Non-technical streams.
·         Hence, The same ratio should be implemented for this Non-Technical cadre (existing only in the Ordnance Factories) for maintaining parity in hierarchical set up and the job evaluation as narrated above.

This can be further supplemented through incoming suggestions if any

  (6)      GRANT OF ACP / MACP
Existing

After 6 CPC, as per existing provisions of MACP, Central Govt employees can get maximum three financial up gradations after the period of 10/20/30 years of service, in case they have  not got the promotions. But these up-gradations are to be granted in the Next Grade Pay and not in the Next grade Pay of the Promotional level( ie promotional hierarchy).The Principal Bench CAT New Delhi, Pun & Haryana High Court have already given judgments in favour of granting MACP in Next grade Pay of the Promotional level . The SLP filed by Govt of India in Supreme Court has also been dismissed. But till date the Govt has not given any clearance to implement the same. So the first natural demand becomes Grant of MACPs in the Next Promotional Grade Pay. Any other proposal may also be suggested.

(7) ALLOWANCES

(A) Dearness Allowance (D A )

Basis of DA 
From 1-1-2006 DA is payable on the average 12 monthly  % increase over  115.763 (Base Year 2001=100 ) ,to which the revised( 6 CPC ) pay-scale relates. This is being sanctioned twice in a year payable from 1st Jan & 1st July reckoned on the following basis:-
·         The increase in  twelve monthly average price index (AICPI (IW)  points is determined twice  in a year for the period ending December & June.
·         The % increase is taken in whole no only and the fraction ignored.
·         Neutralization  is 100% uniformly for all the employees.

After Vth CPC the 50 % DA was merged with Basic Pay and was treated as Dearness Pay (DP) and was being counted for the purpose of Payment of allowances, Transfer grant, Retirement benefits etc. But after 6 CPC this system has been dispensed with and the 50 % DA has not been merged with Pay till date, despite demand from employees federations. So the demand arises that as and when the DA crosses 50% it should be merged with Basic Pay for payments of various allowances/ retirement benefits etc so as to.neutralize the effect of inflation  to some extent .Any further proposal may be suggested.

(09) Retirement / Terminal  Benefits

(a)  Gratuity


Retirement  Gratuity  is admissible to all the employees who retire after completion of 5 years of qualifying service at the rate of one fourth of the emolument for each completed six monthly period of qualifying service subject to max. of 16 .5  times the emoluments or Rs 10 Lakhs whichever is less. Emoluments include Dearness Allowance on the date of cessation of service

 (b) Pension

Amount of Pension  is related  to the length of qualifying service and average of the emoluments drawn by him during Ten months immediately preceding the date of retirement/last pay drawn whichever is beneficial.

Full Pension  is admissible to an employee with qualifying service of not less than 20 years. The amount of Pension will be 50% of the average emoluments/last Pay Drawn  and should not be less than 50% of the minimum of the pay scale held at the time of retirement,subject to min of Rs 3500.

Family Pension  The amount of Family Pension is 30% of the average emoluments/last Pay Drawn by the deceased employee subject to minimum Rs 3500/pm

Increased Pension/Family Pension for Old Pensioners/Family Pensioners

After 6 CPC the following increase in Pension/Family Pension has been made

(C) Commutation of Pension

Every pensioner is eligible to commute a portion (not more than 40% of  his monthly pension for a lump sum payment which is the commuted value of that portion of pension

It is pertinent to mention that after 6 CPC the quantum of payment towards commutation has been considerably reduced/decreased by the Govt as per Revised Commutation Table.The factor for commutation has been reduced from 9.81.to 8.194 (For Age Next Birth Day 61 Yrs)  This has considerably reduced the total lump some money payable on commutation. The reason being the increase of interest rate on the payment of commutation value from 4%  to 8%. The commuted portion of pension is restored after a period of 15 years, even after revising the Commutation Table downwards (reducing the lump some amount payable).The Govt has not reduced the restoration period. As per  calculations the Restoration period for commuted pension should be reduced from existing 15 years to 10 to 12 years. This remains the first demand. Other proposals if any be suggested.

 Existing (Before 6 CPC)  For Rs 1  = 1x 9.81x12   = Rs 117.72 
 Revised  (After 6 CPC)  For  Rs 1  = 1 x 8.194x12 = Rs 98.328 Difference  =  Rs 19.392

 Thus For Every Rs 1/ Pension Commuted, the retiring employee is loosing Rs 19.392  Due to                      
  revised / modified commutation table. Hence the Justification.

·         Further Proposal if any

         Other Generalised Issues which shall be incorporated/highlighted with    
         proper Justifications  :

  • Increase in DA is based on Increase in All India Consumer Price Index (AICPI) IW  which is calculated for some specified goods & services only, called "Basket of Goods". This  needs a relook (by adding more services & factors related to rising cost of Housing, Higher Education, & Medical needs etc) to have realistic figures for estimating the actual price rise/inflation.

  • Dearness  Allowance should invariably be merged with Pay when it reaches 50% to reduce the erosion in Pay Packet.

  • Wage Revision for Central Govt Employees Should be every Five Years as applicable to   PSUs

  • Parity In Pension/Family pension between Pre & Post CPC Retirees

  • Implementation of Judgments which reaches Finality, for All Similarly placed employees  to avoid chain litigations

NOTE  The Central Executive shall draft a comprehensive memorandum on all the issues related to the employees. But only few very important issues have been enumerated above. Any specific proposals, on matter relating to Other allowances including Daily Allowance on Tour, Entitlement & Quantum of various Advances ,Retirement Benefits, LTC etc and other left-over issues not covered above may also be suggested if desired .
