position of Issues
1. Publication
of Seniority List of CM & Promotion from CM to JWM of the year 2013-14:
The current status of the subject
issue is that 5-6 factories have still not send their data/details for which
the Chairman & DGOF and Member/Per-OFB is shows very much concern and the
factories were asked to send the above data at their own level.
After
rigorous efforts by CEHQ/AIANGOs the promotion of CM (T&NT) to JWM(T&NT)
for the year 2013-14 will be finalized by OFB order by the 2nd week
of March 2014. The under mentioned promotion will be on the basis of old
seniority list available with OFB. Expected promotion details mentioned below :

2- Review DPC for the year 2013-14 &
DPC for the year 2014-15:
As
you all are aware that the above matter is pending due to finalization of
seniority list.
3. Cadre
Review of Chargeman and JWMs :
OFB has already send the proposal to
create a post of JWM (SG) in the G.P. Rs 5400 (PB-2).
In continuation of the above the OFB
send an another new proposal for JWM to the MoD for approval as under
1. To create a post of JWM(SG-2) in the G.P. Rs
5400 (PB-2) for 2746 post
2. To Create a post of JWM(SG-1) in the G.P. Rs
5400 (PB-3) for 1000 post
Apart from the
above condition it is further intimated that 165 (approx) post of JWM has to be
surrendered in acceptance of above proposal and it is pending with MOD at
present.
In addition to above this issue and query was raised
during the CE meeting held on 5th March-14 at Bhishma Club, HVF
Estate Avadi, Chennai regarding the action & opinion of CEHQ/AIANGOs. In
this regard it is to inform that the views & opinion of AIANGOs in this
matter is very clear as briefed by GS during the above meeting and we are
submitting the subject proposal very soon to OFB.
4. Recruitment of Chargeman :
During the JCM-III meeting the OFB official stated that all the
hurdles in this matter are resolved and the tender opening for service agency
will be done by 28th Feb/2014. After finalization of service agency
for recruitment process the further action will be taken accordingly.
6. Corrective
action on anomaly in promotion for CM-NT (OTS) & OS to JWM-NT(OTS) :
The
issue was already taken up with DOP&T for obtaining One time
relaxation. Further, Cadre Review proposals for clerical Cadre has been
referred to M of D with the following proposals vide OFB letter Dt 13.02.2014

As
per the chart shown above its seems that the ratio of Tech & Non-Tech as
demanded by AIANGOs at par, and also assured by OFB to maintain parity with
them equal to 40% (Tech) is not seen any where it is still 30%.
Therefore the association is not
convinced with the above proposal and I, again raised the issue on behalf of
AIANGOs for equal ratio of T&NT.
7. SRO of CM-T/NT :
AIANGOs
proposed for the qualification of LDCE Chargeman to be incorporated
in SRO of Chargeman, that the Diploma obtained through an institute/university
duly approved/recognized by UGC/MHRD/DEC/IGNOU/AICTE or any other establishment
of Government of India empowered to grant such approval/ recognition.
In addition to above AIANGOs insisted that the Distance
Education needs to be considered as the employees cannot acquire qualification
through full time Diploma, because employees working in remote areas do not
have any facility near to them. Further acquiring Diploma/Degree is only
eligibility criteria for selection & final selection will be done after
qualifying all requisite test. Therefore, the Diploma/Degree obtained through
distance education should be considered eligible for appearing to Chargeman post
through LDCE Quota both for Tech and Non-Tech.
Chairman
while replying said that, on this distance education issue we need to take a
longer view and settle the matter at the earliest.
8.
Promotion
from JWM to AWM
DPC
Papers for promotion from JWM to AWM are put up to the Appropriate Authority in
UPSC for constitution of DPC/fixing the
Date. DPC will be held in UPSC after finding the mutually agreed date by the
DPC Members.
9. Preliminary Meeting of & 7th CPC Committee of OFB with Office Bearers of
Federations and Associations to decide modality:
The
Meeting was held on 26th Feb/2014 in OFB under the chairmanship of
Shri Aditya Mishra, Sr.DDG & Chairman & 7th CPC Committee of
OFB. All CPC Committee Members (OFB) and two Office Bearers of each federations
& Associations under OFB attended the meeting. The undersigned and our President Shri U.K.
Jaiswal also attended the meeting on behalf of AIANGOs.
Aim of the
Meeting as per OFB,s Letter No: 01/7th CPC/2014 (part)
dtd:18/01/2014: was Consultation with representatives of Federations and
Associations on Methodology to be followed in the matters & issues to be
projected before 7th CPC and the areas/ material/data to be justify
special consideration to O. F. Organization vis a vis other organisations
/cadres.
Keeping
focus on the aim of the meeting the President Shri U.K. Jaiswal presented our
views before the committee in the meeting.
10. Payment of PLB to DR Ch’man
on Probation :
This burning issue was settled in the interest
of cadre vide OFB letter No. 07/09/12-A/HRD Dated: 14-02-2014 after rigorous
efforts & unity of AIANGOs.
11. Escort duty related grievances
with specific reference to chemical & explosive factories
Issue was discussed
in detail for implementation the decision for granting of OT & submission
of self certified bills for food during Escort journey duty at the road side
hotels of the Escorters. However the present status is as follows: for granting
OT on escort duty is under examination by OFB finance and so for self certified
bills for food during Escort journey is concern, the rep. of PCofA stated that
this issue solved by our end shortly.
However the OF Chanda
Branch of AIANGOs has already filled a suite at Mumbai CAT (Nagpur Bench) for
not deputing of Chargeman cadre on escort duty, which is fully supported by
AIANGOs, the final decision is still awaited.
12. 7th
Central Pay Commission Terms of Reference – Cabinet approved ToR of 7th CPC
a) To
examine, review, evolve and recommend changes that are desirable and feasible
regarding the principles that should govern the emoluments structure including
pay, allowances and other facilities/benefits, in cash or kind, having regard
to rationalization and simplification therein as well as the specialized needs
of various Departments, agencies and services, in respect of the following
categories of employees:-
i. Central Government
employees-industrial and non-industrial
ii. Personnel belonging to the All
India Services;
iii. Personnel of the Union Territories;
iv. Officers and
employees of the Indian Audit
and Accounts Department;
v. Members
of regulatory bodies (excluding the Reserve Bank of India) set up under Acts of
Parliament; and
vi. Officers and employees of the
Supreme Court.
b) To examine, review, evolve and
recommend changes that are desirable and feasible regarding principles that
should govern the emoluments structure, concessions and facilities/benefits, in
cash or kind, as well as retirement benefits of personnel belonging to the
Defence Forces, having regard to historical and traditional parities, with due
emphasis on aspects unique to these personnel.
c) To work out the framework
for an emoluments structure linked with the need to attract the most suitable
talent to Government service, promote efficiency, accountability and
responsibility in the work culture, and foster excellence in the public
governance system to respond to complex challenges of modern administration and
rapid political, social, economic and technological changes, with due regard to
expectations of stakeholders, and to recommend appropriate training and
capacity building through a competency based framework.
d) To examine the existing
schemes of payment of bonus, keeping in view, among other things, its bearing
upon performance and productivity and make recommendations on the general
principles, financial parameters and conditions for an appropriate incentive
scheme to reward excellence in productivity, performance and integrity.
e) To review the variety of
existing allowances presently available to employees in
addition to pay and suggest their rationalization and simplification, with a
view to ensuring that the pay structure is so designed as to take these into
account.
f) To examine the principles
which should govern the structure of pension and other retirement benefits,
including revision of pension in the case of employees who have retired prior
to the date of effect of these recommendations, keeping in view that retirement
benefits of all Central Government employees appointed on and after 01.01.2004
are covered by the New Pension Scheme (NPS).
g) To make recommendations on
the above, keeping in view:
i. the economic conditions in the
country and need for fiscal prudence;
ii. the need to ensure that adequate
resources are available for developmental expenditures and welfare measures;
iii. the likely impact of the
recommendations on the finances of the State Governments, which usually adopt
the recommendations with some modifications;
iv. the prevailing emolument
structure and retirement benefits available to employees of Central Public
Sector Undertakings; and
v. the best global practices and
their adaptability and relevance in Indian conditions.
h) To recommend the date of
effect of its recommendations on all the above.
The
Commission will make its recommendations within 18 months of the date of its
constitution. It may consider, if necessary, sending interim reports on
any of the matters as and when the recommendations are finalised.
The decision
will result in the benefit of improved pay and allowances as well as
rationalization of the pay structure in case of Central Government employees
and other employees included in the scope of the 7th Central Pay Commission.
Background
Central Pay Commissions are periodically constituted to go into various issues
of emoluments’ structure, retirement benefits and other service conditions of
Central Government employees and to make recommendations on the changes
required
13. Framing of recruitment
rules for the post of Master Craftsman (MCM) and Chargeman both in the same grade pay of Rs.
4200 – Proposed by MoD
With
reference to the MoD proposal vide MoD letter ID No. 11(5)/2009-D(Civ-I) Dated:
23rd January 2014 in respect of framing recruitment rules for the post of Master Craftsman (MCM) and Chargeman
both in the same grade pay of Rs. 4200. The AIANGOs disagree with the MoD
proposal and mentioned the following
proposals for further processing –
Since the percentage strength of JWM (T)and Chargeman (T) is
as
follows :

In view of the above existing
ratio & strength of JWM-T (6911), CM-T (10320) & MCM (12675) = 29906.
The 40% of the above strength including all cadre will be 11962 which
strength to be sanctioned for the post of JWM(T). Where as the existing JWM(T)
sanction post is 6911, which is less 5051 than the present sanction post of
JWM(T) and further will be required for sanction.
In view of the above explained
scenario it is further proposed that the
entry level of MCM & Chargeman (T&NT) is GP-4200 however the
responsibility is quite deferent as the MCM is working under the control of
Chargeman, who is the line in charge of that group bearing all the higher
responsibility of his group on behalf of HOS. Therefore keeping view of the
higher responsibility of the Chargeman in comparison to MCM, the Chargeman should be granted GP Rs. 4600/- and it should
be ensure that MCM next promotion will be in Chargeman with GP Rs. 4600.
During the discussion in large the official side fully supported the
subject proposal of AIANGOs. There after the DGOF & Chairman-OFB added that
we may also take views of all GMs/Sr. GMs in this matter.
14. Fixation of pay on promotion to a post ( MCM to CM, CM-II
to CM-I, AF to JWM) carrying higher duties
and Responsibilities but carrying the same grade pay.
There
is an order of pay fixation of pay on promotion to a post carrying
higher duties and Responsibilities but carrying
the same grade pay by the Ministry of Finance on Dt: 7.01.2013 which was
reproduced by the OFB. It is understood that the clause of this letter is
neither accepted by PCofA, nor any further action taken by OFB end in this
regard. However there is CAT Banglore Bench vide its original Application No.
407/2009 Dt 11th April 2011 given decision in favor of the
applicants. During the discussion the copy of the decision of CAT Banglore
Bench was produced by AIANGOs. Taking in view of the above decision the OFB
officials expressed that after going through the decision this issue may be
consider.
However the AIANGOs authorized the RFI
Branch of AIANGOs for advanced preparation of court case on the subject. The note portion leading to issue of Ministry
of Finance (Department of Expenditure) OM No. 10/02/2011-E.III-A dated:
7.01.2013 was asked & received by RFI branch of AIANGOs through RTI.
15. MACP in the hierarchy of Post in light of
CAT Chandigarh, High Court Chandigarh, Principal CAT New Delhi judgments and
rejection of SLP by Supreme Court.
During
discussion OFB expressed that we have send letters to DOP&T in the light of
above decision for their further guidelines.
In
addition to the above stated circumstances, IOFGOA had also filled a suite
before CAT principal bench on the above subject.
16. JWM
Transfers
Against 600 applications seeking transfers, in one sitting about
120 Medically ground applications were
cleared. The remaining will be cleared on stagewise by Member/Per with
the assistance of NG Section Officers very soon. Further the pending
transfer order which were cancelled earlier was assured for reconsideration
during meeting.
OTHER ISSUES
a) Proposal for 7th CPC
A complete Questionnaire prepared for Branches/Zones for
submitting their views/proposals to CE , on various core issues to be
represented to the 7th Pay
Commission for circulation the same amongst their members to discuss in their
GB meeting, and give feedback to the CEHQ, but in response only OF Medak branch
send complete proposal for 7th CPC to CEHQ and few branches has also
send proposal in part.
All the
branches/zones are requested to go through the points mentioned questionnaire
and forward their comments to CEHQ latest by 31st March 2014
b) SUBSCRIPTION
FOR THE YEAR 2013
As you all are aware that the subscription of all the members has
already been deducted from the salary of July 2013. It is further requested all
the branches of AIANGOs to make sure that the levy of CEHQ to be deposited
through Cheque/DD in favour of AIANGOs CE Hd. Qtr. Field Gun Factory Kanpur by 31st
March 2014.
